The introduction of the Professional Engineers Registration Act 2019 (Act) will require Victorian Councils to undertake effective due diligence reviews of their operations to ensure compliance with the new Act. This will require a review of roles and responsibilities of engineering and technologist staff within each organisation.

The Act, which comes into operation from 1 July 2021 will require engineers who provide professional engineering services in the areas of structural, civil, electrical, mechanical and fire safety engineering to register unless they work under direct supervision or only in accordance with a prescriptive standard.

Engineers who provide professional engineering services to the building industry will need to have a special endorsement on their registration. Engineers who are already registered under the Building Act 1993 will not need to apply for registration and endorsement as they will be automatically transferred to the new system.

The risk to councils is that staff providing services may not be suitably registered as required under the Act. There is also the potential risk regarding professional indemnity if unregistered staff undertake professional engineering services which require registration.

CT Management Group have conducted a pilot project with Colac Otway Shire Council and are currently conducting a pilot project with the City of Monash.

The project involves reviewing the organisation structure for roles impacted by the new Act, reviewing related position descriptions, interviewing key stakeholders, and compiling a report with recommendations for the council to action.

The information compiled as part of the project will help inform the Council of tasks and actions needed to be completed to respond to effective due diligence regarding the new requirements of the Act.
